Terms of Service

1. Acceptance of Terms

By accessing and using the services of F&K Estimatings, you agree to comply with and be bound by the following terms and conditions. If you do not agree to these terms, please do not use our services.

2. Services Offered

F&K Estimatings provides construction cost estimating, quantity takeoffs, and bid consultation. Our estimates are based on the documentation (blueprints, specs) provided by the client and market data available at the time of the estimate.

3. Accuracy & Liability

While we strive for the highest degree of accuracy (typically within 2-3% of actual costs), F&K Estimatings does not guarantee that actual construction costs will not vary from our estimates. We are not liable for any financial losses, bid rejections, or project overruns resulting from the use of our estimates.

4. Payment Terms

Clients agree to pay the flat-rate fees agreed upon before the delivery of services. For large or recurring projects, a retainer or milestone payments may be required as specified in the individual project proposal.

5. Intellectual Property

The templates, methodologies, and specialized software tools used by F&K Estimatings remain our exclusive property. The final estimate or takeoff report becomes the property of the client upon full payment.

6. Detailed Scope of Work

Each individual project proposal sent by F&K Estimatings specifically outlines the "Scope of Work" being estimated. This includes the CSI divisions covered and the specific set of drawings/addendums used for the takeoff. Any item or trade not explicitly listed in our proposal is excluded from the final estimate. It is the client's responsibility to verify that our scope matches their specific bidding requirements before processing payment.

7. Technical Clarification Period

Upon delivery of the final estimate and color-coded markups, F&K Estimatings provides a 14-day technical clarification period. During this window, clients can request explanations regarding our measurement methodologies or ask for minor adjustments based on the original blueprints. Revisions requested due to new addendums, design changes, or scope expansion after the initial delivery may be subject to additional consulting fees.

8. Governing Law

These terms and any disputes arising from the use of our professional estimating services shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions.
